AppyPilgrim Terms of Service

These Terms govern your use of the AppyPilgrim mobile application (“AppyPilgrim”, “the app”) operated by:

(referred to in these Terms as “we”, “us”, “our”). By installing or using the app you agree to these Terms. If you do not agree, do not use the app.

The short version. AppyPilgrim is a free walking-route companion. Use it responsibly outdoors, double-check routes against official sources before relying on them, treat AI answers as suggestions rather than facts, and don’t abuse the service. We are not liable for injuries, weather, or anything that goes wrong on the trail — your safety is your responsibility.

1. Who can use the app

You must be at least 13 years old (or the age of digital consent in your country, whichever is higher) to create an account. If you are between 13 and the age of majority in your country, you confirm that a parent or legal guardian has reviewed these Terms.

2. Your account

You can use AppyPilgrim as a guest with reduced functionality, or sign in with Apple ID or a magic-link email. You are responsible for keeping access to your sign-in method secure. If you suspect unauthorised access to your account, contact support@appypilgrim.com immediately.

One person, one account. Don’t share accounts.

3. The licence we grant you

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use AppyPilgrim on devices you own or control, for your own non-commercial use, subject to these Terms and Apple’s App Store Terms.

5. The on-device AI assistant (“Appy AI”)

AppyPilgrim offers two assistant modes:

The assistant is a language model. It can be wrong. Do not rely on it for safety-critical decisions — weather, routing in difficult terrain, medical questions, or emergency situations. Always cross-check important information against official sources, local guides, or trail authorities.

You may report any AI response that is inaccurate or inappropriate using the “Report this response” action in the chat. Reports go to our support inbox and we review them manually.

6. Walking routes and trail data

Walking is at your own risk. Trails change. Weather changes. GPS can be inaccurate in forests, canyons, or under cloud cover. Beacons, signs, and road conditions on the ground are the authoritative source — not the app.

Route data in AppyPilgrim is curated from public sources, official tourism boards, partner organisations, and our own surveys. We make reasonable efforts to keep it accurate but we do not guarantee:

Before any walk, check current conditions with local trail authorities, the relevant tourism office, and an up-to-date weather forecast. Carry a paper map and compass for any multi-day or remote route. Tell someone where you are going.

7. Emergency / SOS feature

The in-app SOS action attempts to send your last known GPS coordinates to an emergency contact you have configured and to open a phone call to 112 (the EU emergency number). It is a convenience feature. It is not a substitute for a properly registered emergency device or a personal locator beacon. Cellular and GPS coverage are not guaranteed. We accept no liability for failed or delayed messages, missed calls, or any consequence thereof.

8. User-generated content

Where the app allows you to add content (display name, profile picture, support messages, AI-response reports), you grant us a worldwide, non-exclusive, royalty-free licence to host and display that content for the purpose of running the app. You retain ownership. You confirm you have the right to share what you upload.

9. Pricing

AppyPilgrim is free in this version. There are no in-app purchases, no subscriptions, and no advertising. The optional on-device AI model download is free. Future versions may introduce paid tiers — those will be clearly labelled and you will never be charged without explicit consent.

10. Intellectual property

AppyPilgrim, its logos, the “Appy” character and brand, route descriptions we authored, photographic content we commissioned, and the app’s code are protected by copyright and other intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our written permission, except for the limited personal-use licence in section 3.

The bundled inference engine (llama.cpp) is open-source software under the MIT licence. The on-device model weights (Gemma) are governed by Google’s Gemma Terms of Use (ai.google.dev/gemma/terms). By using the on-device assistant you agree to those terms in addition to these.

11. Third-party content and services

The app may surface third-party content (tourism information, partner offers, public domain points of interest). We are not responsible for the accuracy or availability of third-party content or services. Your interactions with third parties (e.g. booking accommodation through a partner integration in a future version) are governed by their own terms.

12. Disclaimers

To the maximum extent permitted by law, the app is provided “as is” and “as available”, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.

13. Limitation of liability

To the maximum extent permitted by law, neither AppyPilgrim nor its officers, employees, or affiliates will be liable for any indirect, incidental, special, consequential, or exemplary damages, including damages for personal injury, loss of profits, data, goodwill, or other intangible losses arising from or related to your use of the app. Our aggregate liability for any direct damages will not exceed the greater of (a) the amount you have paid us in the past 12 months — which for the free tier is zero — or (b) ten euros (€10).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by gross negligence or wilful misconduct, and consumer rights that cannot be waived).

14. Indemnity

You agree to defend and hold us harmless from any third-party claims, damages, or expenses arising out of your misuse of the app, your breach of these Terms, or your violation of any rights of another person.

15. Termination

You can stop using the app and delete your account at any time from Profile → Preferences → Delete Everything. We may suspend or terminate your access if you breach these Terms or if we discontinue the service. On termination, the licence in section 3 ends and we erase your personal data within 30 days, as set out in the Privacy Policy.

17. Changes to these Terms

We may update these Terms as the app evolves. Material changes will be communicated through an in-app notice or by email at least 14 days before they take effect. Continued use of the app after changes take effect means you accept the updated Terms. If you do not accept them, stop using the app and delete your account.

18. Governing law and jurisdiction

These Terms are governed by the laws of the Italian Republic, without regard to conflict-of-laws principles. Disputes will be brought before the competent courts of Rome, Italy (the registered seat of AppyPilgrim S.r.l.), except where mandatory consumer-protection law in your country of residence requires otherwise. Nothing in this section deprives EU consumers of the protections of the law of the EU member state in which they reside.
