Terms of Service
Please read these Terms of Service ("Terms") carefully before using the AppyPilgrim mobile application (the "App") operated by AppyPilgrim ("we", "us", "our").
By using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Description of service
AppyPilgrim is a walking route discovery and navigation app that provides route information, AI-powered trail assistance, GPS navigation, and fitness tracking for hikers and walkers.
2. Route and trail data disclaimer
- Routes are compiled from publicly available sources including government registries, OpenStreetMap, and community databases. We do not independently verify trail conditions, accessibility, safety, or accuracy.
- Trail conditions change due to weather, seasons, landslides, construction, closures, and natural events. A route shown in the App may be impassable, dangerous, or closed at any given time.
- GPS coordinates and navigation guidance are approximations. GPS accuracy varies with terrain, vegetation, weather, and device capability. Do not rely solely on GPS navigation in remote or mountainous areas.
- Elevation profiles, distances, difficulty ratings, and estimated walking times are calculated from digital data and may not reflect actual conditions.
You are solely responsible for your own safety when following any route. Always:
- Check current trail conditions with local authorities before setting out
- Carry appropriate equipment, supplies, and communication devices
- Inform someone of your planned route and expected return time
- Turn back if conditions become unsafe
- Follow local regulations, trail closures, and warning signs
We expressly disclaim any and all liability for injury, death, property damage, or any other loss arising from the use of route data, navigation guidance, or any other information provided in the App. Use of the App's route and navigation features is entirely at your own risk.
3. AI assistant disclaimer
The Appy AI assistant provides general information about routes, weather, packing, and local culture. AI-generated responses:
- May contain inaccuracies or outdated information
- Should not be relied upon for safety-critical decisions
- Are not a substitute for professional advice (medical, legal, or otherwise)
- Do not constitute professional navigation guidance
4. Account and registration
- You may use the App without creating an account (guest mode).
- If you create an account, you are responsible for maintaining the confidentiality of your credentials.
- You may delete your account at any time from the App settings.
5. Acceptable use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to access systems, data, or accounts not intended for you
- Interfere with the App's operation or other users' experience
- Submit false or misleading information
- Use the App in a way that could endanger yourself or others
6. Intellectual property
- The App, its design, content, features, and underlying technology are owned by AppyPilgrim and protected by intellectual property laws.
- Route data is compiled from public sources and community contributions. Individual route descriptions and editorial content are our original work.
- You may not copy, modify, distribute, or create derivative works based on the App without our written permission.
7. Health and fitness features
- Health and fitness data (steps, distance, heart rate) is displayed for informational purposes only.
- The App is not a medical device and does not provide medical advice.
- Consult a healthcare professional before starting any new physical activity program.
- The SOS feature is an aid, not a guaranteed emergency service. Always carry independent means of communication in remote areas.
8. Bookings and payments
- When available, the App may facilitate bookings for accommodations, transport, or experiences through third-party providers.
- We act as an intermediary only. The contract is between you and the service provider.
- Payments are processed securely via Apple Pay and Stripe. We do not store credit card details.
- Cancellation and refund policies are set by individual service providers.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
- WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
- WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY ROUTE DATA, NAVIGATION GUIDANCE, AI RESPONSES, WEATHER INFORMATION, OR OTHER CONTENT.
- IN NO EVENT SHALL APPYPILGRIM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
- OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR EUR 50, WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify and hold harmless AppyPilgrim, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or violation of any rights of a third party.
11. Governing law
These Terms are governed by the laws of Italy. Any disputes shall be resolved in the courts of Rome, Italy.
12. Changes to these Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of material changes through the App.
13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
